WHAT IS COPYRIGHT:

Copyright is a form of legal protection granted to the creators of original works of authorship, including literary, artistic, musical, and other creative works. This protection gives the creators exclusive rights to control the use and distribution of their works for a certain period of time. Copyright law gives creators of original material the exclusive right to further use and duplicate that material for a given amount of time. Once a copyright expires, the copyrighted item becomes public domain.

When someone creates a product that is viewed as original and required significant mental activity to create, this product becomes an intellectual property that must be protected from unauthorized duplication. Examples of unique creations include:

  • Novels
  • Art
  • Poetry
  • Musical lyrics and compositions
  • Computer software
  • Graphic designs
  • Film
  • Original architectural designs
  • Website content

BENEFITS OF COPYRIGHT:

Copyright offers several important benefits to creators and society as a whole:

Protection of Creative Works:

Copyright provides creators with legal protection for their original works, including literary, artistic, musical, and other creative expressions. This protection encourages creators to invest time, effort, and resources into producing new works without fear of unauthorized copying or exploitation.

Financial Incentive:

By granting creators exclusive rights to their works, copyright serves as a financial incentive for artistic and intellectual endeavors. Creators can earn income from the exploitation of their copyrighted works through licensing, sales, royalties, and other forms of commercialization.

Encouragement of Innovation:

Copyright fosters a culture of innovation and creativity by rewarding creators for their original contributions to society. The prospect of copyright protection encourages creators to push the boundaries of artistic expression, explore new ideas, and develop innovative works that enrich cultural and intellectual discourse.

Promotion of Cultural Diversity:

Copyright protects and preserves diverse cultural expressions by safeguarding the rights of creators from different backgrounds and traditions. By providing creators with the means to control the use and dissemination of their works, copyright helps maintain cultural authenticity and integrity in a globalized world.

Facilitation of Access to Knowledge:

While copyright grants creators exclusive rights to their works, it also promotes the dissemination of knowledge and information by allowing for limited exceptions and limitations to copyright protection. These exceptions, such as fair use/fair dealing provisions, enable the use of copyrighted works for purposes such as education, research, criticism, commentary, and news reporting, thereby fostering the free exchange of ideas and information.

Preservation of Artistic Legacy:

Copyright ensures the preservation and accessibility of cultural heritage by protecting the rights of creators and their heirs. By safeguarding the economic interests of creators and incentivizing the conservation of their works, copyright contributes to the long-term preservation of artistic and intellectual heritage for future generations.

Overall, copyright plays a crucial role in promoting creativity, innovation, cultural diversity, and the dissemination of knowledge, thereby enriching the cultural and intellectual fabric of society.

COPYRIGHT RENEWAL

The validity of the Copyright  is 60 years. It is necessary to renew Copyright registration. Registered Copyright can be renewed by filing a renewal application. Copyright registration can be renewed starting from 6 months before the date of
expiry. A notice for intimation of renewal is sent before the date of expiry.

In the case of a person failing to renew the Copyright on time, the registrar is at liberty to remove the Copyright from the Copyright journal. The registrar may remove the Copyright from the journal however, it can be done by him only after 12 months after the expiry date. The trademark can be renewed even after the expiry date on the payment of a fine through a process called restoration.
